Q: HOW DO I CHECK THE LEGALITY OF ESTATE AGENTS IN SPAIN?
A: This is not difficult - unfortunately there are a number of illegal property sellers in Spain.
To protect yourself always ensure the agency has:
- An office (sounds simple doesn´t it) - there are many individuals who tout property around cafés and bars, ALWAYS ask to go to their office.
- Registered trading number, plus certificate issued by the relevant government department - ALWAYS ask for the registration number for the company - even an individual (a sole trader) has a registration number in the name of their trading company.
- Company escritura - ALWAYS ask to see the escritura of the company. All company formations as in property purchases HAVE to be signed in front of a notary. There will always be an escritura for a LEGAL company.
- Town hall registration with plan -ALWAYS ask to see the registration at the ayuntamiento to include the plan that will have been lodged with the townhall detailing the offices and the function for which they are registered.
- Insurance -ALWAYS ask to see the relevant insurance documents.
NEVER PAY DEPOSITS TO PURCHASE PROPERTY IN SITUATIONS OTHER THAN THE OFFICE OF AN INMOBILIARIA OR THE OFFICE OF A NOTARY.

Q: IS CATALUNYA AFFECTED BY LAND GRAB?
A: No this is not happening in Catalunya.
The area affected is Valencia, much further to the south, where the Valencian authorities brought in the LRAU (land grab law), under an Urban Development Act . This act was originally brought in to generate a housing programme for low paid workers and aimed at foiling speculators who bought cheap scrubland and then gained huge profitrs when the land was declared as urbanisation land.
It has been reported (18/04/05) that following an investigation by MEP´s into this matter, the Spanish authorities have been given until next month to end the practice, which is considered to be in breach of EU laws on property ownership and infringes human rights or be brought before the European Courts of Justice where they may face heavy fines.
The ruling is said to have opened the doors to those who have been affected by this law to claim compensation for their losses.
